The Marietta City Council welcomes you here and thanks you for your time and concerns. Should you wish to address the council, this is the time set on the agenda for you to do so. When you are recognized, please step to the podium and state your name and address prior to addressing council. Your comments will be limited to three minutes. The council may not respond to your comments this evening, rather they may take your comments and suggestions under advisement and your questions may be directed to the appropriate staff person for follow-up. In the event of a violation of decorum, the council president will give one warning. Should a violation continue, the council president may revoke the speaking privileges, and the speaker may be subject to removal from the council chambers by the sergeant-at-arms.

• Resolution No. 96 (20-21) A resolution to adopt and approve a substantial amendment to the 2019 Community Development Action Plan and to authorize the filing of same with the U.S. Department of Housing and Urban Development (HUD), and declaring an EMERGENCY. (SCALES)

• Resolution No. 97 (20-21) A resolution to adopt and approve the 2021-23 Community Development Consolidated Plan and associated 2021 Action Plan and to authorize the filing of same with the U.S. Department of Housing and Urban Development (HUD), and declaring an EMERGENCY. (SCALES)
• Resolution No. 98 (20-21) A Resolution to accept the donation of a historical sign and to authorize the Marietta Rowing and Cycling Club to place the historical sign behind the Marietta Lockmaster House, with the specific location of the sign to be at the discretion and approval of the Director of Public Safety and Service for the City of Marietta, Ohio. • Ordinance No. 243 (20-21) An Ordinance to amend Section 161.02 HOLIDAYS of the Codified Ordinances of the City of Marietta, Ohio, relating to the Juneteenth Holiday celebrated on June 19th provided annually to all City officials and employees not otherwise provided for by contract or separate ordinance. • Ordinance No. 247 (20-21) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into a work agreement with State of Ohio, Department of Transportation, on behalf of the City of Marietta, Ohio, which contains a temporary work easement required for the I-77 Culvert and Sleeve Project. • Resolution No. 100 (20-21) A Resolution to express the sincere appreciation of the City of Marietta, Ohio and the Marietta City Council to Ryan Smith and others for their donation for the Marietta Trail Maintenance Fund established through the Marietta Community Foundation. (FARNSWORTH)

Legislation First Reading
• Ordinance No. 249 (20-21) An Ordinance to appropriate and/or transfer funds. (SCALES)

• Ordinance No. 250 (20-21) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into a change order to the present contract between the City of Marietta, Ohio and NLS Asphalt Paving, Inc., for necessary changes to the 2021 Citywide Asphalt Paving/ADA Curb Ramps Project in the amount of $33,928.65, and declaring an EMERGENCY. • Ordinance No. 251 (20-21) An Ordinance to authorize Cindy Murphy of 331 Ohio Street, Marietta, Ohio to make certain improvements upon the street right of way along the 300 block of Ohio Street in the City of Marietta, Ohio, upon the express condition that it indemnify and hold harmless the City of Marietta, Ohio, its officers, employees, agents, successors and assigns from any and all liability arising out of the construction or use of said street right of way, and to authorize the construction of the improvements called for herein upon the issuance of all proper permits required, and declaring an EMERGENCY. • Ordinance No. 252 (20-21) An Ordinance by the Council of the City of Marietta, Ohio to accept the Fact Finder Award dated July 30, 2021 and authorize and direct the Law Director of the City of Marietta, Ohio and the Director of Public Safety and Service to comply with its notice obligations under O.A.C. 4117-9-05 and to take all necessary steps to draft and execute a successor Collective Bargaining Agreement consistent with the Fact Finder Award and declaring an EMERGENCY. • Resolution No. 103 (20-21) A Resolution to authorize the City of Marietta, Ohio to accept donations of a swing and a bench by ARC of Washington County, and to further authorize their placement in the City of Marietta, Ohio. (FARNSWORTH)

• Resolution No. 104 (20-21) A Resolution of acknowledgement and support of the work and fund-raising efforts of The Start Westward Monument Society, Inc., soon to be re-titled The Start Westward Memorial Society, Inc., an Ohio non-profit corporation, regarding the restoration and preservation of The Memorial Monument to the Start Westward of the United States, located in Muskingum Park, in the City of Marietta, Ohio. • Resolution No. 105 (20-21) A Resolution to authorize and direct the Mayor to apply, on behalf of the City of Marietta, Ohio, to the Ohio Public Works Commission for total funding of $400,000.00 in the form of a $300,000.00 grant and a $100,000.00 loan for the 2022 Citywide Asphalt Resurfacing & ADA Curb Ramp Project; and to obligate the necessary matching funds from the City if funding is approved, and declaring an EMERGENCY. • Resolution No. 106 (20-21) An Emergency Resolution to accept the material terms of the OneOhio Subdivision Settlement pursuant to the OneOhio Memorandum of Understanding and consistent with the terms of the July 21, 2021 National Opioid Settlement Agreement and to authorize the Law Director to execute the Participation Agreement for the OneOhio Subdivision Settlement, and declaring an EMERGENCY.
