Public Hearing - Susan Vessels, Council President - Section 509.08(b) of the Codified Ordinances of the City of Marietta, titled “Disturbing the Peace”. Request to amend the ordinance to extend the noise limit from 11:00 p.m. to 12:00 a.m. on Friday and Saturday nights only.

The council may not respond to your comments this evening, rather they may take your comments and suggestions under advisement and your questions may be directed to the appropriate staff person for follow-up. In the event of a violation of decorum, the council president will give one warning. Should a violation continue, the council president may revoke the speaking privileges, and the speaker may be subject to removal from the council chambers by the sergeant-at-arms.

• Ordinance No. 109 (22-23) An Ordinance to amend Ordinance 280 (20-21), passed November 4, 2021, and to authorize and direct the Mayor; the Director of Public Safety and Service; and the Auditor of the City of Marietta, Ohio, to enter into an Amended Master Equity Lease Agreement and an Amended Five (5) Year Capital Plan with Enterprise Fleet Management Trust, and declaring an EMERGENCY. • Resolution No. 33 (22-23) A Resolution to acknowledge that the City of Marietta, Ohio supports Woda Cooper Companies, Inc. of Columbus, Ohio, in its endeavor to apply for and obtain bond gap financing to support new construction of up to fifty (50) units of affordable workforce housing at 318 Colegate Drive, Marietta, Washington County, Ohio; and to further acknowledge that the City of Marietta, Ohio further pledges $1.5 million dollars from the City’s American Rescue Plan Act (ARPA) Funds to support the development, contingent upon Woda Cooper Companies, Inc. receiving the bond gap financing that it is applying for in the August funding round, and declaring an EMERGENCY. • Ordinance No. 111 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to temporarily suspend the operation of DORA (Designated Outdoor Refreshment Area) during the Marietta Sternwheel Festival, from 8:00 p.m. until midnight on Friday September 9, 2022; and from 8:00 p.m. until midnight on Saturday, September 10, 2022, and declaring an EMERGENCY. • Ordinance No. 112 (22-23) An Ordinance to approve the authorization of expenditures from the American Rescue Plan Act Funds and to enter into a contract with Vasco Sports Contractors for professional consulting and design work for the Marietta City Tennis and Pickleball Court Design Project and declaring and EMERGENCY. • Ordinance No. 113 (22-23) An Ordinance to approve the authorization of expenditures from the American Rescue Plan Act Funds and to enter into a contract with Gra-Con Electric for the Temporary Electric at Gold Star Park Project and Declaring and EMERGENCY. (FARNSWORTH)

• Ordinance No. 114 (22-23) An Ordinance to approve the authorization of expenditures from the American Rescue Plan Act Funds for the purchase of one (1) limited edition, Silent Battle Bronze Sculpture that is to be created by sculptor, Anita Miller, and installed at Gold Star Park. This project known as the Gold Star Park Silent Battle Bronze Sculpture Project shall be at a cost not to exceed $55,290.00 and declaring and EMERGENCY. (FARNSWORTH)

• Resolution No. 34 (22-23) A Resolution to accept the recommendation of the Tax Incentive Review Council and to approve the continuation of the Community Reinvestment Area Agreement entered into between the City of Marietta, Ohio and Perry Associates Holdings, LLC, and declaring an EMERGENCY. • Resolution No. 35 (22-23) A Resolution to accept the recommendation of the Tax Incentive Review Council and to approve the continuation of the Community Reinvestment Area Agreement entered into between the City of Marietta, Ohio and Historic Hippodrome/Colony Theater, and declaring an EMERGENCY.
