The Marietta City Council welcomes you here and thanks you for your time and concerns. Should you wish to address the council, this is the time set on the agenda for you to do so. When you are recognized, please step to the podium and state your name and address prior to addressing council. Your comments will be limited to three minutes. The council may not respond to your comments this evening, rather they may take your comments and suggestions under advisement and your questions may be directed to the appropriate staff person for follow-up. In the event of a violation of decorum, the council president will give one warning. Should a violation continue, the council president may revoke the speaking privileges, and the speaker may be subject to removal from the council chambers by the sergeant-at-arms.

• Ordinance No. 106 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to specifically waive and/or modify the operation of Marietta City Ordinance Section 509.08 (b) Titled: DISTURBING THE PEACE, from 11:00 p.m. to 12:00 a.m. for the Townhouse Outdoor Concert dates of Saturday, July 23, 2022; Saturday, July 30, 2022; Friday, August 5, 2022; and Saturday, August 13, 2022, and declaring an EMERGENCY. • Ordinance No. 107 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into Change Order No. 1 to the present contract between the City of Marietta, Ohio and Pickering Associates of Parkersburg, West Virginia, for the 304 Putnam Street ADA Compliance Upgrade Project in the City of Marietta, Ohio, in an amount not to exceed Twenty-Two Thousand, Eight Hundred Dollars ($22,800.00) and declaring an EMERGENCY. • Ordinance No. 108 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into a contract with Alan Stone Company, Inc. of Cutler, Ohio for the Marietta Walking Trail Slip Repair Project, in the amount of $1,470,000.00, and declaring an EMERGENCY. • Ordinance No. 109 (22-23) An Ordinance to amend Ordinance 280 (20-21), passed November 4, 2021, and to authorize and direct the Mayor; the Director of Public Safety and Service; and the Auditor of the City of Marietta, Ohio, to enter into an Amended Master Equity Lease Agreement and an Amended Five (5) Year Capital Plan with Enterprise Fleet Management Trust, and declaring an EMERGENCY. • Ordinance No. 110 (22-23) An Ordinance to appropriate and/or transfer funds. (SCALES)

• Resolution No. 32 (22-23) A Resolution to accept a donation of monies from the Marietta Community Foundation, a non-profit organization, on behalf of the City of Marietta, Ohio, to be used for maintenance of the Off-Road Mountain Bike and Hiking Trails located within the City limits of Marietta, Ohio. Said donation shall be in the amount of $4,000.00 and disbursed from the Trail Maintenance Fund established through the River Valley Mountain Bike Association. Said monies shall to be used to cover the cost of maintenance for the Off-Road Mountain Bike and Hiking Trails, pursuant to a bid/work order with Chelli, LLC. located at 307 Holly Street, Marietta, Ohio. Furthermore, this Resolution shall be to accept this generous donation of monies with the sincere appreciation and thanks of the City of Marietta, Ohio, and the Marietta City Council, to Ryan Smith and others associated with the River Valley Mountain Bike Association and the Marietta Community Foundation. • Resolution No. 33 (22-23) A Resolution to acknowledge that the City of Marietta, Ohio supports Woda Cooper Companies, Inc. of Columbus, Ohio, in its endeavor to apply for and obtain bond gap financing to support new construction of up to fifty (50) units of affordable workforce housing at 318 Colegate Drive, Marietta, Washington County, Ohio; and to further acknowledge that the City of Marietta, Ohio further pledges $1.5 million dollars from the City’s American Rescue Plan Act (ARPA) Funds to support the development, contingent upon Woda Cooper Companies, Inc. receiving the bond gap financing that it is applying for in the August funding round, and declaring an EMERGENCY.
