The council may not respond to your comments this evening, rather they may take your comments and suggestions under advisement and your questions may be directed to the appropriate staff person for follow-up. In the event of a violation of decorum, the council president will give one warning. Should a violation continue, the council president may revoke the speaking privileges, and the speaker may be subject to removal from the council chambers by the sergeant-at-arms.

• Ordinance No. 9 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to execute and enter into a Nonexclusive Revocable License Agreement on behalf of the City of Marietta, Ohio, with Emanual’s LLC; owner of 284 and 286 Front Street, and David Labes, a.k.a Ari Gold, owner and operator of TLV Restaurant., to grant a Revocable License for the limited use of the public right of way, a portion of the sidewalk in front of 284 and 286 Front Street; and to waive the operation of Section 529.07(b)(3) of the Codified Ordinances of the City of Marietta, Ohio, prohibiting opened containers of beer or intoxicating liquor in public places, for a portion of the sidewalk in front of 284 and 286 Front Street in the City of Marietta, Ohio, and declaring an EMERGENCY. • Ordinance No. 13 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into a contract with Shoaf Consulting LLC of Dublin, Ohio to provide professional engineering and consulting services to assist the City of Marietta, Ohio in value engineering in the final implementation of the Water Treatment Plant Project, in an amount not to exceed $44,198.00, and declaring an EMERGENCY. • Ordinance No. 14 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into a contract with Pickering Associates of Parkersburg, West Virginia, for project construction management and professional value engineering services for the Water Treatment Plant project, and declaring an EMERGENCY. • Ordinance No. 16 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into Change Order No. 6 to the present contract between the City of Marietta, Ohio and Woolpert, Inc., of Columbus, Ohio, for necessary changes to the Start Westward Project, Phase 1, in the City of Marietta, Ohio, in an amount not to exceed $9,500.00, and declaring an EMERGENCY. • Ordinance No. 18 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into a contract with Pickering Associates of Parkersburg, West Virginia, for Professional Engineering and Design and Survey Services for the Concentrate Sewer as part of the Water Treatment Plant Project, and declaring an EMERGENCY. • Ordinance No. 19 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into contracts with Atlas Technical Consultants, LLC of Gahanna, Ohio, for Pre-Demolition Hazardous Material survey services for the Water Treatment Plant Project in an amount not to exceed $14,570.00, and declaring an EMERGENCY. • Ordinance No. 20 (22-23) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into a contract with Great Lakes Community Action Partnership of Freemont, Ohio, for Water Rate Study and Report related to the Water Distribution and Water Treatment Plant project for in an amount not to exceed $7,500.00, and declaring an EMERGENCY. • Resolution No. 6 (22-23) A Resolution to authorize and direct the Director of Public, Safety and Service to install or place a six (6) foot Pullman Bench with back package plaque on behalf of Yvonne Balfour on City property in East Muskingum Park near the gazebo, pursuant to the requirements of the Marietta Park Bench Donation Program Specification guideline. • Resolution No. 7 (22-23) A Resolution to authorize and direct the Director of Public Safety and Service and City Engineer to submit a DEFA Funding Assistance Nomination Form the Ohio EPA Office of Financial Assistance on behalf of the City of Marietta, Ohio for the Marietta Water Treatment Plant Project; and declaring an EMERGENCY. • Resolution No. 8 (22-23) A Resolution to authorize and direct the Auditor of the City of Marietta, Ohio to enter into a Subrecipient Agreement on behalf of the City of Marietta, Ohio with Washington County Homeless Project Inc., 333 Fourth Street, Marietta, Ohio for a grant sum of $15,000.00 as a necessary and eligible expenditure to provide a Drop In Center at the First Congregational United Church of Christ Parsonage, 312 Front Street, Marietta, Ohio for homeless residents of Washington County and the City of Marietta, Ohio through the ARPA Funds, and declaring an EMERGENCY. • Resolution No. 9 (22-23) A Resolution to authorize and direct the Director of Public Safety and Service and to execute a Memorandum of Understanding (MOU) on behalf of the City of Marietta, Ohio relating to the Memorial to the Start Westward of the United States and its related Parkland; and declaring an EMERGENCY.
