The Marietta City Council welcomes you here and thanks you for your time and concerns. Should you wish to address the council, this is the time set on the agenda for you to do so. When you are recognized, please step to the podium and state your name and address prior to addressing council. Your comments will be limited to three minutes. The council may not respond to your comments this evening, rather they may take your comments and suggestions under advisement and your questions may be directed to the appropriate staff person for follow-up. In the event of a violation of decorum, the council president will give one warning. Should a violation continue, the council president may revoke the speaking privileges, and the speaker may be subject to removal from the council chambers by the sergeant-at-arms.

• Ordinance No. 264 (20-21) An Ordinance to amend Section One of Ordinance No. 4 (20-21), passed January 16, 2020 in order to modify the source of monies for the payment of the salary for the Development Department Administrator of the City of Marietta, Ohio. (SHOAF)

• Resolution No. 117 (20-21) A Resolution by the Council of the City of Marietta, Ohio to ratify and consent to the tentative settlement terms negotiated between the Mayor of the City of Marietta, Ohio and the Board of Commissioners of Washington County Ohio, which resolve litigation arising from the alleged breach of the 2011 Intergovernmental Agreement and declaring an EMERGENCY. • Ordinance No. 274 (20-21) An Ordinance to create the position of Clerk in the Department of Property Maintenance for the City of Marietta, Ohio, to designate the duties thereof, to establish the salary and benefits thereof, and to amend Exhibit A of the City’s Table of Organization to Ordinance No. 186 (20-21) passed April 1st, 2021, and declaring an EMERGENCY. • Resolution No. 118 (20-21) A Resolution to authorize and direct the Director of Public Safety and Service to enter into a PHA Service Agreement on behalf of the City of Marietta, Ohio, with The Community Action Program Corporation of Washington-Morgan Counties, Ohio, for the operation of a public housing agency and declaring an EMERGENCY. Legislation First Reading
• Ordinance No. 275 (20-21) An Ordinance to create the part time position of a Zoning Enforcement Officer in the Department of Property Maintenance; to designate the duties thereof; to establish the rate of pay thereof; and to amend Exhibit A of the City's Table of Organization, and an EMERGENCY. (SHOAF)

• Ordinance No. 276 (20-21) An Ordinance to authorize St. Luke's Lutheran Church, 401 Scammel Street, Marietta, Ohio, to make certain improvements upon the street right of way along the 400 block of Fourth Street in the City of Marietta, Ohio, upon the express condition that it indemnify and hold harmless the City of Marietta, Ohio, its officers, employees, agents, successors and assigns from any and all liability arising out of the construction or use of said street right of way. This Ordinance is further to authorize the construction of the improvements called for herein upon the issuance of all proper permits required. (BOYER)

• Ordinance No. 277 (20-21) An Ordinance to authorize and direct the Director of Public Safety and Service to advertise for bids for the leasing of Room 12 (250 sq. ft.) in the Marietta Area Community Center at the Armory in the City of Marietta, Ohio, and to direct that the Director of Public Safety and Service return said bids with his recommendation for acceptance to the Marietta City Council within fifteen (15) days of the bid opening, and declaring an EMERGENCY. • Ordinance No. 278 (20-21) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into a contract on behalf of the City of Marietta, Ohio, with Horton Emergency Vehicles of Grove City, Ohio, for the purchase of an emergency rescue vehicle for use by the Fire Department of the City of Marietta, Ohio, at a cost not to exceed $251,404.01 under the auspices of Ohio's Cooperative Purchasing Act as administered by the Ohio Department of Administrative Services, Office of State Purchasing, and declaring an EMERGENCY. • Ordinance No. 279 (20-21) An Ordinance to amend Section 141.06 (b) of the Codified Ordinances of the City of Marietta, Ohio, Titled; CONTRACT FOR FIRE PROTECTION, and to repeal former Section 141.06 (b) that is inconsistent, or in conflict with said amendment. (GOSSETT)

• Ordinance No. 280 (20-21) An Ordinance to amend Ordinance 99 (20-21), passed August 20, 2020, and to authorize and direct the Mayor, the Director of Public Safety and Service, and the Auditor of the City of Marietta, Ohio, to enter into a Master Equity Lease Agreement and a Five (5) Year Capital Plan with Enterprise Fleet Management Trust and declaring an EMERGENCY. • Ordinance No. 282 (20-21) An Ordinance to amend the Codified Ordinances of the City of Marietta, Ohio, Part Eleven, Planning and Zoning Code, to change the classification of 325 North Seventh Street, Marietta, Washington County, Ohio, (Tax Parcel Nos. 24-0096476.000; 24-0096477.000; 24-0096478.000), from a "R-2" Single Family Detached Residential District. to a "R-3" General Residential District. • Resolution No. 120 (20-21) A Resolution accepting the amounts and rates as determined by the Budget Commission and authorizing the necessary tax levies and certifying them to the County Auditor, and declaring an emergency. (SCALES)


• Resolution No. 121 (20-21) A Resolution by the Council of the City of Marietta, Ohio, to authorize and direct the Auditor of the City of Marietta, Ohio to transfer American Rescue Plan Act (ARPA) Funds in the amount of $1,715,102.10 from the 291 Local Fiscal Recovery Fund to the various proper and eligible funds which lost revenue due to the COVID-19 pandemic as outlined in Exhibit "A" attached hereto and incorporated herein, and declaring an EMERGENCY.
