The Marietta City Council welcomes you here and thanks you for your time and concerns. Should you wish to address the council, this is the time set on the agenda for you to do so. When you are recognized, please step to the podium and state your name and address prior to addressing council. Your comments will be limited to three minutes. The council may not respond to your comments this evening, rather they may take your comments and suggestions under advisement and your questions may be directed to the appropriate staff person for follow-up. In the event of a violation of decorum, the council president will give one warning. Should a violation continue, the council president may revoke the speaking privileges, and the speaker may be subject to removal from the council chambers by the sergeant-at-arms.

• Ordinance No. 199 (20-21) An Ordinance to vacate a portion of an unnamed alley located in Gracey & Kaiser’s Subdivision of Putnam and Spalding Company Lot 13 on Harmar Hill found in Plat Book 2, Page 50, of the Plat Records of Washington County, Ohio and surrounded by lands owned by Jessica Lynn Beaumier in Lot Nos. 13, 26, 28 and 29 as described in Volume 580, Page 1752 – 1754, Official Records of Washington County, Ohio. (BOYER) – Motion to amend, add EMERGENCY Clause to Section 3 and title, add Terry & Kristi LeMasters consent to exhibit.

• Ordinance No. 203 (20-21) An Ordinance with ODOT for sidewalk replacement, lighting, monument restorations, ADA modifications and way finding signs along Front Street and Washington Street, as well as the Museum District and the East Muskingum Park, and declaring an EMERGENCY. (BOYER)

• Ordinance No. 207 (20-21) An Ordinance to find and determine that a certain parcel of real property owned by the City of Marietta, Ohio, located at 205 Cedar Street, Marietta, Ohio, is not needed for any municipal purpose; to authorize and direct the Director of Public Safety and Service to advertise for bids for the sale thereof; and to direct that the Director of Public Safety and Service return said bids with his recommendation for acceptance to the Marietta City Council within fifteen (15) days of the bid opening, and declaring an EMERGENCY. • Ordinance No. 214 (20-21) An Ordinance to amend the Salary Step Schedule of the City of Marietta, Ohio, to establish salaries and increased salaries for all non-union and non-elected positions of employment with the City for calendar year 2021, and declaring an EMERGENCY. (SHOAF) – Motion to amend exhibit with corrected Step Schedule.

• Ordinance No. 217 (20-21) An Ordinance to estimate the amount of active, inactive, and interim monies of the City of Marietta, Ohio, to be awarded for the period from September 19, 2021, to and including September 18, 2026; to provide for notice thereof to depositories eligible to apply to serve as depositories of active, inactive, and interim funds of the City of Marietta, Ohio; and to establish the time for the meeting of the Marietta City Council to so designate said depositories. • Resolution No. 92 (20-21) A Resolution to authorize the Eagle Scout Project of William Casey Yannitell, a junior at the Washington County Career Center and a member of BSA Troop 207, to be completed on the grounds of Gold Star Park in the City of Marietta, Ohio. (FARNSWORTH)

• Ordinance No. 220 (20-21) An Ordinance to amend Section 1339.03 of the Codified Ordinances of the City of Marietta, Ohio, pertaining to the International Property Maintenance Code and declaring an EMERGENCY. (BOYER)(GOSSETT)

• Ordinance No. 221 (20-21) An Ordinance to authorize and direct the Director of Public Safety and Service to enter into Change Order No. 4 to the present contract between the City of Marietta, Ohio and Kirk Bros. Co. Inc., for necessary changes to the Marietta Waste Water Treatment Plant Aeration Systems Upgrade and Improvement Project in the amount of $5,062.50, and declaring an EMERGENCY. (MCCAULEY)

• Ordinance No. 222 (20-21) An Ordinance to authorize the Hippodrome/Colony Historical Theatre Association to construct certain improvements upon the street right of way for Third Street in the City of Marietta, Ohio and to further authorize the Hippodrome/Colony Historical Theatre Association to utilize a portion of the sidewalk on the street right of way for Third Street at that location for the installation of a hydraulic lift upon the express condition that it indemnify and hold harmless the City of Marietta, Ohio, its officers, employees, agents, successors and assigns from any and all liability arising out of the use of said sidewalk and street right of way, and declaring an EMERGENCY. • Ordinance No. 223 (20-21) An Ordinance to authorize and direct the Director of Public Safety and Service to advertise for bids for the application of asphalt to various streets in the City of Marietta, Ohio and to replace/install ADA curb ramps, as part of the City’s 2021 Asphalt Resurfacing and ADA Curb Ramp Project, and to direct that the Director of Public Safety and Service return said bids with his recommendation for acceptance to the Marietta City Council within fifteen days of the bid opening and declaring an EMERGENCY. • Ordinance No. 224 (20-21) An Ordinance with ODOT for pedestrian improvement project in the City of Marietta. Locations include: Butler Street, Putnam Street, 2nd, 3rd, 4th, Front Street, Washington Street and Marion Street. Work includes pavement markings, signs, RRFB's and signal timing, and declaring an EMERGENCY. (BOYER)

• Ordinance No. 225 (20-21) An Ordinance to authorize and direct the Director of Public Safety and Service to apply for, and accept, the terms of a supplemental loan agreement to OWDA Loan #7628, for planning of Marietta Water Treatment Plant Renovation and Upgrade Project between the City of Marietta and the Ohio Water Development Authority and declaring an EMERGENCY. • Ordinance No. 226 (20-21) An Ordinance to authorize Zack Powell of Ridge Runner Construction LLC, Aaron Reynolds, and volunteers as friends of the Marietta Skate Park, to construct certain improvements to the Marietta Skate Park located at Indian Acres Park in the City of Marietta, Ohio upon the express condition that Ridge Runner Construction LLC and Aaron Reynolds indemnify and hold harmless the City of Marietta, Ohio, its officers, employees, agents, successors and assigns from any and all liability arising from the construction of said improvements to the Skate Park, and declaring an EMERGENCY. • Ordinance No. 227 (20-21) An Ordinance to authorize and direct the Director of Public Safety and Service to advertise the intent of the City of Marietta, Ohio, to request qualifications and proposals from qualified Law Firms, Zoning and Development Consultants, and Land Use Zoning and Development Firms for the comprehensive updating and re-writing of Chapter Eleven: Planning and Zoning Code of the Codified Ordinances for the City of Marietta, Ohio, and declaring an EMERGENCY. • Resolution No. 93 (20-21) A Resolution to adopt the tax budget for the City of Marietta, Ohio, for the calendar year 2022, and to provide for submission of the same to the Auditor of Washington County, Ohio, and declaring an EMERGENCY. (SCALES)
